1. Agreement to Terms

By engaging Pro Quality Home Inspection for home inspection services, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you (the "Client") and Pro Quality Home Inspection (the "Inspector").

2. Scope of Inspection

Our home inspections are visual examinations of the readily accessible areas of the property performed in accordance with InterNACHI Standards of Practice. The inspection includes:

  • Structural components and foundation
  • Roof, attic, and ventilation systems
  • Electrical systems and components
  • Plumbing systems and fixtures
  • HVAC and heating systems
  • Interior and exterior elements
  • Basement and crawlspace areas

The inspection is not exhaustive and does not include areas that are not readily accessible without damaging property or risking personal safety.

3. Limitations

The inspection does not include:

  • Cosmetic items or aesthetics
  • Underground items including septic systems and underground fuel tanks
  • Specialty inspections (radon, mold, asbestos, lead paint) unless specifically contracted
  • Code compliance assessments
  • Insects, pests, or wood-destroying organisms (unless WDI inspection is contracted)
  • Environmental hazards
  • Geological and soil conditions

4. Report and Findings

A comprehensive written report will be delivered within 24 hours of the inspection completion. The report is for the exclusive use of the Client. The Inspector is not responsible for any conclusions or actions taken by third parties based on the report.

5. Payment Terms

Payment is due at the time of inspection unless other arrangements have been made in advance. We accept cash, check, Visa, Mastercard, American Express, Discover, and PayPal. A cancellation fee may apply if the inspection is cancelled within 24 hours of the scheduled appointment.

6. Limitation of Liability

The Inspector's liability for errors, omissions, or defects in the inspection or report shall be limited to a refund of the fee paid for the inspection. The Inspector shall not be liable for any consequential, special, or incidental damages. The Client agrees that the Inspector is not an insurer or guarantor against defects in the property or its components.

7. Client Responsibilities

The Client is responsible for:

  • Ensuring all utilities (water, electric, gas) are turned on for inspection
  • Providing safe and reasonable access to all areas of the property
  • Reading and understanding the complete inspection report
  • Seeking further evaluation from qualified specialists for any concerns identified
  • Making the final decision regarding purchase or repair of the property

8. Dispute Resolution

Any disputes arising from this agreement shall be resolved through binding arbitration in accordance with the laws of the State of New York. The prevailing party shall be entitled to reasonable attorney fees and costs.

9. Modifications

Pro Quality Home Inspection reserves the right to modify these terms at any time. Any modifications will be effective immediately upon posting to our website.
